This page sets out what you can rely on from the rest of this site, and what you cannot. It is short. Please read it before you act on anything you have read here.

Everything here is general information

Our pages, guides and blog posts describe how conveyancing generally works in Victoria and South Australia. They are written for a general reader. They are not advice about your contract, your title, your land or your settlement, because we have not seen any of those things.

Your transaction will contain facts a general page cannot know about. A special condition at the back of a contract. An easement across the rear of the block. A sunset date in an off the plan contract. Any one of those changes the answer completely, so please do not treat a page here as a substitute for someone reading your actual documents.

Reading this site does not make you our client. We act for you once you have engaged us in writing, and not before. Until then nothing here is a professional opinion about your matter.

Check the figures

Law, duty rates and government fees change

Conveyancing sits on top of legislation, duty rates, thresholds, concessions and government fees, and all of those move. State budgets change them. Concessions get introduced or withdrawn. Fees are indexed. A page that was correct the day it was written can be wrong a year later without a single word on it changing.

So we date our pages and we check them. We still ask you to confirm any rate, threshold or eligibility rule with the authority that sets it. They publish the current position, free to read.

Scope

A licensed conveyancer is not a solicitor

We are licensed in Victoria under the Conveyancers Act 2006 (Vic) and registered in South Australia under the Conveyancers Act 1994 (SA). That licence covers conveyancing work: the sale, purchase and transfer of land, the documents that go with it, and settlement. You can check any conveyancer on the public register kept in Victoria by the Business Licensing Authority / Consumer Affairs Victoria, and on the one kept in South Australia by Consumer and Business Services.

Some matters look like property matters but are legal work outside that licence. We do not act on them and we do not advise on them, on this site or in person. If any of the following is what you actually need, see a solicitor. Saying so early saves you money.

  • A dispute with the other party, or anything heading to VCAT or a court
  • Wills, probate and estate planning
  • Trusts, company structures and business structuring
  • Tax advice, and whether a duty concession or exemption applies to you
  • Family law property settlements and the orders behind them
  • Commercial leasing
  • Self managed super fund and foreign investment questions
  • Building disputes, defects and anything about the condition of a property

The same goes for the parts of a purchase that belong to other trades. We read the paperwork and the title. A building inspector reads the building. Where a page here touches on that work, it is pointing you to the right person rather than doing their job.

Read this one twice

If you get an email changing our bank details, stop

Settlements move large sums, and criminals know it. Someone gets into an email account, reads the conversation quietly, then sends a message carrying new account details. The address is a character or two off the real one. The signature looks right, and so does the timing, because they have been watching.

We will not email you new bank details partway through a matter. If anything arrives that changes where your money is to be sent, treat it as fraud until you have proved otherwise.

Before you transfer a cent

  • Ring us on 0450 016 397, using the number on this site. Never a number printed in the email.
  • Confirm the account name, BSB and number out loud with someone you have spoken to before.
  • Do not reply to the message, and do not click a link in it.
  • If your bank allows it, send a small test amount first and ring to confirm it landed.

Money sent to a fraudulent account is very hard to get back, and it is often moved on within hours. A phone call takes a minute.

Timeframes

Where we describe how long something usually takes, that is a general pattern and not a promise about your matter. Settlement timing depends on lenders, councils, water authorities and the other side, and none of those are ours to control.
