1. Accepting these terms

By using wisestep.com.au you accept the terms set out on this page. If any of it does not sit well with you, please stop using the site and call us instead. In these terms, "we", "us" and "our" mean Wise Step Conveyancing, the licensed conveyancing practice at Office 4, Level 1, 105A High Street, Cranbourne VIC 3977. "You" means whoever is using the site.

2. Information, not advice

The pages, guides and blog posts here describe how conveyancing generally works in Victoria and in South Australia. They are written for a general reader. They are not written for your matter, because we have not seen your matter.

Property law shifts, and so do the facts. Two blocks in the same street in Clyde North can carry different planning conditions, different covenants and a different settlement risk. Nothing on this site is legal advice, financial advice, or advice about stamp duty or tax, and nothing here replaces having someone read your own contract. If you want to know where you actually stand, send us the contract and the vendor statement and we will look at it properly.

Reading the site, printing something from it or submitting a form does not create a client relationship. We act for you once we have agreed to act and you have that agreement from us in writing.

Some work sits outside what a licensed conveyancer may do at all. Disputes and tribunal proceedings, wills and probate, trusts and company structures, and family law orders belong with a solicitor. If your question turns out to be one of those, we will tell you and point you on rather than take the work.

3. Using this site

You are welcome to read the site, print pages for your own use and share links to it. Please do not:

• republish our content, in whole or in substantial part, as though it were yours,
• use the site or its forms to send anything unlawful, misleading, abusive or deceptive,
• scrape or bulk collect the site, or harvest the contact details on it for marketing,
• submit someone else's personal details without their say so, or
• interfere with the site, its security, or anyone else's use of it.

4. Intellectual property

The words, structure, design, photographs and code on this site belong to us or to the people who licensed them to us. Quote a short passage if it helps, with a link back to the page you took it from. Anything beyond that needs our written permission first. Our business name and logo are ours as well. Legislation, government forms and public register material referred to on the site remain the property of whoever publishes them, and their conditions of use apply to that material, not ours.

5. Links to other sites

We link out to places that tend to help: Consumer Affairs Victoria, Consumer and Business Services in South Australia, the State Revenue Office, council planning pages, Land Use Victoria. We do not control any of them. A link is not an endorsement of that organisation or of anything it says, and we are not responsible for what you find there, for what happens if you act on it, or for what that site does with information you give it. Once you leave us, their terms and their privacy policy apply, not ours.

6. Accuracy and outside sources

We take care with what we publish and we revisit it when the law moves. Even so, we do not warrant that everything here is current, complete or free of error, and that applies with more force to anything drawn from a third party or a government source. Duty rates, thresholds, grant conditions, lodgement rules and fees all change, sometimes at short notice and sometimes part way through a financial year.

Check the position for your own matter before you act on it, either with us or with the authority responsible for it.

7. Availability of the site

We would like the site up at all hours and usually it is, but we cannot promise it. Maintenance happens, and so do outages we do not control. We may change, suspend or withdraw any part of the site without notice. If the site is down and you need us, ring 0450 016 397. The office is open Monday to Friday, 9am to 5pm, and available on weekends by appointment.

8. Liability

To the extent the law allows, we are not liable for loss or damage arising from your use of this site, from anything published on it, from a delay or an error in that content, or from the site being unavailable when you wanted it. That exclusion covers indirect and consequential loss, and loss of profit or opportunity.

This clause is about the website. It does not limit the duties we owe a client in a matter we have been engaged on. Those duties come from the Conveyancers Act 2006 (Vic), from our professional obligations as a licensed conveyancer, and from the engagement we sign with you. We carry professional indemnity insurance for that work.

9. Your consumer law rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or under any other law that cannot be excluded by agreement. If something in these terms conflicts with one of those rights, the right wins and that part of these terms does not apply.

Where a consumer guarantee applies to services we have supplied and the law permits us to limit our liability for a failure to comply with it, our liability is limited to supplying those services again, or to paying the cost of having them supplied again.

10. Privacy

What we collect through this site, why we collect it and what we do with it afterwards is set out in our privacy policy. Please read it alongside these terms. Conveyancing also requires us to verify your identity, and the privacy policy explains how that works.

11. Changes to these terms

We may change these terms. The version published on this page is the version that applies, and it applies from the moment it goes up. Have a look at this page occasionally if you use the site regularly. Continuing to use the site after a change means you accept the changed terms.

12. Governing law

These terms are governed by the law of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Victoria. If a court finds part of these terms unenforceable, that part is severed and the rest continues to apply.
